We celebrate, on September 26, 2025, the 30th anniversary of the enactment of Law No. 9,099/95, which established the State Special Civil and Criminal Courts and other provisions within the Brazilian legal framework. In fact, it was preceded by the Law of Small Claims Courts (Law No. 7,244/84), which, despite its virtues, faced obstacles that prevented it from fully achieving its purpose (e.g., the lack of jurisdiction to enforce its own judgments).
Foreshadowed by the 1988 Federal Constitution — which, in Article 24, item X, established concurrent jurisdiction among the Union, the States, and the Federal District for the “creation, operation, and procedure of small claims courts” — the Union duly enacted Law No. 9,099/95, requiring the States, within six months, to create within their territories the Special Civil and Criminal Courts, as well as to define their organization, composition, and jurisdiction, as set forth in Articles 93 and 95 of the aforementioned law.
